Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the Navibite mobile application, together with any related websites, features, and services (collectively, the “Service”). By downloading, accessing, or using Navibite, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About Navibite
Navibite is a food-exploration application that helps people in Myanmar discover local street food, tea shops, and restaurants. Navibite is a discovery and information service. We are not a food-delivery service, a restaurant, or a party to any transaction between you and any food vendor. Listings, ratings, photos, and recommendations are provided for informational purposes only.

2. Eligibility
•    You must be at least 13 years old to create an account. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
•    You must provide accurate information when registering and keep it up to date.
•    You are responsible for all activity that occurs under your account and for keeping your login credentials secure.

3. Your Account
You may create an account using your email address, phone number, or a supported social login (such as Google or Facebook). You may not share your account, impersonate another person, or create an account using false information. Notify us promptly at navibite@gmail.com if you believe your account has been accessed without authorisation.

4. Acceptable Use
When using Navibite, you agree that you will not:
•    Post content that is false, misleading, defamatory, obscene, hateful, or that infringes the rights of others;
•    Submit fake reviews, ratings, or listings, or manipulate the discovery or ranking features;
•    Upload content you do not own or have permission to share, including photographs of other people without their consent;
•    Use the Service for any unlawful purpose, or in violation of Myanmar law;
•    Attempt to reverse-engineer, scrape, overload, or interfere with the Service or its underlying systems, or circumvent any security or rate-limiting measures;
•    Use bots, automated scripts, or bulk methods to access the Service except through interfaces we expressly provide.

5. User Content
“User Content” means reviews, ratings, photos, comments, saved lists, and any other material you submit to Navibite. You retain ownership of your User Content. By submitting it, you grant Navibite a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example, resizing or compressing images for low-bandwidth delivery), publish, and display that content within the Service and in connection with promoting the Service.
You are solely responsible for your User Content and confirm you have the rights necessary to submit it. We may, but are not obliged to, review, moderate, or remove User Content that we reasonably believe violates these Terms.

6. Food Listings & Third-Party Information
•    Information about vendors — including opening hours, prices, menus, location, and availability — may be supplied by vendors, users, or third-party sources and may not always be accurate or current.
•    Navibite does not endorse or guarantee any vendor, and is not responsible for the quality, safety, hygiene, or legality of any food or service you obtain from a vendor.
•    Any dealings you have with a vendor — including payment, pick-up, and food safety — are solely between you and that vendor.

7. Intellectual Property
The Navibite name, logo, application, design, and all related software and content (excluding User Content) are owned by [Company Legal Name] and are protected by applicable intellectual-property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Service for your own non-commercial use. You may not copy, distribute, or create derivative works from the Service without our written permission.

8. Service Availability
We aim to keep Navibite available and to design it to work under intermittent or slow network conditions. However, we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time, and may release updates that you need to install to keep using it.

9. Suspension & Termination
We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, if we are required to do so by law, or if we reasonably believe your conduct harms Navibite, other users, or vendors. You may stop using the Service and delete your account at any time, as described in our Account Deletion Policy.

10. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Navibite does not warrant that content or listings are accurate, complete, or reliable.

11. Limitation of Liability
To the fullest extent permitted by applicable law, Navibite and [Company Legal Name] will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Service, your reliance on any listing or recommendation, or any transaction with a vendor. Nothing in these Terms excludes liability that cannot be excluded under Myanmar law.

12. Indemnity
You agree to indemnify and hold harmless Navibite and [Company Legal Name] from any claims, damages, or expenses arising out of your User Content, your use of the Service, or your breach of these Terms, to the extent permitted by law.

13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by other reasonable means before the changes take effect. Your continued use of the Service after the changes become effective constitutes acceptance of the updated Terms.

14. Governing Law & Disputes
These Terms are governed by the laws of the Republic of the Union of Myanmar. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Yangon, Myanmar, without prejudice to any mandatory consumer-protection rights you may have under Myanmar law.
